Terms & Conditions

Welcome to thomcneill.com, operated by THOMAS MCNEILL LLC (“Company,” “we,” “our,” or “us”).

These Terms & Conditions govern your access to our website and your purchase of video editing services and commercial video post-production services.

By accessing our website or placing an order, you acknowledge that you have read and agree to these Terms & Conditions.

2. Services Offered

THOMAS MCNEILL LLC provides digital video production services, including video editing, commercial video post-production, footage organization, visual sequencing, editing refinements, and other related services described on individual service listings.

The exact scope of each project depends on the service description, materials supplied by the customer, and any written project specifications agreed upon before work begins.

Our services are digital services. Customers do not purchase physical merchandise through these service listings.

3. One-Time Purchases and Billing

All services offered through our website are sold as one-time purchases unless a specific written agreement expressly states otherwise.

When you purchase a service, you pay the stated price for the particular service or project described in your order.

Our standard service purchases are not subscriptions.

We do not automatically renew standard service orders, and we do not automatically charge customers recurring fees for the same order.

A new purchase requires a separate order and payment authorization.

Any additional services, expanded project scope, or work outside the original order must be separately discussed and approved by the customer before additional charges are incurred.

4. Order Confirmation and Project Requirements

After an order is placed, we may contact you to confirm project requirements, source materials, preferred editing style, output format, deadlines, and other information necessary to complete the service.

Customers are responsible for providing accurate project information and ensuring that supplied files are accessible and usable.

Production timelines may depend on the timely receipt of all required materials and instructions.

If essential materials or information are missing, the project timeline may be adjusted accordingly.

5. Digital Service Delivery

Our services are delivered digitally. Depending on the project, completed work may be provided through email, a secure file-sharing link, or another agreed electronic delivery method.

No physical shipment, parcel delivery, or shipping fee applies to standard digital service orders.

The expected completion timeframe depends on the service purchased, project complexity, file volume, and receipt of all required materials.

Any specific delivery deadline expressly agreed upon in writing will govern the applicable project.

Customers are responsible for providing a valid email address and ensuring they can access the agreed delivery method.

6. Customer Responsibilities and Intellectual Property

Customers must ensure that they own or have obtained the necessary rights, licenses, permissions, and consents to use any footage, music, images, logos, recordings, or other materials supplied for editing.

Customers must not request work that infringes another party’s copyright, trademark, privacy rights, publicity rights, or other legal rights.

Customers are responsible for backing up their original files before submitting them.

Unless otherwise agreed in writing, customers are responsible for obtaining any third-party licenses required for their intended use of the supplied materials or final video.

Ownership and licensing of project deliverables will be governed by the specific service description and any applicable written agreement. No transfer of third-party intellectual property rights is implied.

7. Revisions and Project Changes

Any included revisions will be limited to the scope stated in the relevant service listing or written project agreement.

A revision means a reasonable adjustment to work already completed within the original project scope.

Requests involving new footage, a different creative direction, additional scenes, substantial restructuring, new deliverables, or other material changes may be treated as additional work.

We will communicate any applicable additional charges and obtain customer approval before proceeding with chargeable extra work.

Customers should review delivered work promptly and provide clear, consolidated feedback.

8. Cancellations and Refunds

Cancellation and refund eligibility depends on the stage of the project and the nature of the issue.

Before work begins, customers may contact us to request cancellation. We will review the request and determine the applicable refund eligibility under the service listing, any written project agreement, and applicable law.

Once production has started, the amount of work completed, resources committed, and project-specific costs may affect the available refund.

Completed and delivered services are generally not eligible for a refund merely because a customer changes their mind, subject to applicable law and any express refund commitment made for the service.

If we fail to provide a purchased service as agreed, customers should contact us so that we can investigate and determine an appropriate resolution.

Nothing in these Terms & Conditions excludes or limits rights that cannot legally be excluded or limited.

The detailed cancellation and refund rules are described in our Cancellation & Refund Policy.

9. Payments

Prices are displayed on the applicable service listing or at checkout.

Payment must be completed through the payment methods made available on our website.

Customers authorize the applicable one-time charge when placing an order.

We do not store complete payment card numbers or card security codes on our own servers. Payment processing is handled by the applicable payment service provider under its own terms and security procedures.

10. Privacy

We collect and process personal information as reasonably necessary to operate our website, process orders, communicate with customers, and provide purchased services.

Our handling of personal information is explained in our Privacy Policy.

11. Service Availability and Technical Issues

We make reasonable efforts to provide our services professionally and to deliver completed files in the agreed format.

However, delivery may occasionally be affected by circumstances beyond our reasonable control, including third-party file-sharing outages, corrupted source files, unavailable customer materials, or technical failures.

If a material issue affects a project, we will make reasonable efforts to communicate with the customer and discuss an appropriate solution.

12. Limitation of Liability

To the extent permitted by applicable law, THOMAS MCNEILL LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services.

To the extent permitted by applicable law, our aggregate liability arising from a particular order will not exceed the amount paid for the specific service giving rise to the claim.

These limitations do not apply where prohibited by law and do not exclude liability that cannot legally be excluded.

13. Governing Law

These Terms & Conditions will be governed by the laws of the State of New York, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

Any dispute will be handled by a court of competent jurisdiction, subject to applicable legal requirements.

14. Changes to These Terms

We may update these Terms & Conditions from time to time.

Updated terms will be posted on this page with a revised effective date. Changes will apply as permitted by applicable law.
